Unlawfully Detained ... Now Lawfully Detained [23rd Aug 2012]
An illegal immigrant who claimed more than £17,000 for being unlawfully detained while his asylum bid was investigated has gone on to commit around 30 offences and has been jailed for two years. Joseph Mjemer had arrived in the UK as a stowaway in 2003 and by the time he was detained by officials he had already carried out more than 20 crimes. He spent four and half years in Home Office custody and received compensation because of this. However he went on to commit another 12 crimes after his release and the judge stated that any mitigating circumstance which may have been in place before no longer exist. The judge said that a custodial sentence was required. The latest string of crimes include threatening behaviour and assault. He also was convicted of possessing anabolic steroids and driving while disqualified. Mjemer claims that his upbringing causes him to have trouble controlling his behaviour. Mary Deller says that she felt a sharp pain and heard a click in her back as she tried to lift the 21Kg bags of coins at the Kent branch of NatWest where she worked. Ms Deller continued to work for one week after the accident and took painkillers for the pain. However she then visited a doctor who sent her to a specialist where bulging discs were diagnosed. She has not been able to return to work since. He compensation payment was to cover lost earnings. Ms Deller says that the experience has left her reliant on painkillers and anti-inflammatory drugs and that she has felt ill and depressed as a result. It transpired that no health and safety advice was given to staff about ow to lift heavy bags of coins. Laura Morgan died when the catamaran she was in capsized at a Greek holiday resort. The firm which sold the holiday, Sunsail were held liable in a Greek civil court, but say they do not accept it and will appeal. Laura's mother Lynne says she is disgusted at the attitude of the company. Two employees of Sunsail were found to be negligent and received 10 month sentences which were suspended for three years. The family were also awarded a six figure payout - however they have received just 20% of this amount so far. Sunsail have said that they regret how the lengthy legal process must be affecting Laura's family. The appeal will take place next year. Deborah Rees has already had her case dismissed and her daughter Emma's case is due to be heard soon. Deborah had been employed by RDS Driving Services Ltd for eight years and travelled regularly over the country. The firm claimed that she was let go from her job due to redundancy and that other redundancies had taken place at the time. However Deborah felt that her job had been given to other employees when she left. Her claim for compensation was rejected because redundancy was reasonable for the company and that restructuring of roles made this inevitable.
