Compensation Denied for MMR Vaccine Side Effects [6th Sep 2012]
It has been claimed that a strain of the MMR vaccine could have caused deafness in at least two children. Katie Stephen who is now 21 has been refused a payment from the Vaccine Damages Payments Unit because her deafness is only in one ear and not serious enough to qualify - however it has been agreed that the damage was caused by the vaccine. Another victim has received the full £120,000 payment because she was left completely deaf in both ears. Katie's mother has pointed out that the damage was done to her by the Department of Health and that they encouraged the take-up of the vaccine. The Payments Unit uses industrial measures to decide whether payment will be made and regards 60% hearing loss as their cut-off point. The Financial Services Authority have said that some of the changes have been required by the European Markets Infrastructure Regulation, but that some additional changes will also be required. These include the introduction of separate client money pools to keep investments segregated from company assets. The FSA has said that they are currently consulting on these proposals and they want to gauge what the appetite is within the industry for change. One of the main points of the restructuring would be a quicker payment of compensation to clients when a firm collapses and a higher return of assets. This could improve confidence in the investment market. The law has already been changed in Scotland and Northern Ireland and new legislation is expected this year in Wales regarding dogs which attack workers on private land. Currently the law in England does not apply to attacks which take place on private land, leaving postal workers with no way to get recompense or compensation. Dave Joyce from the union has said that they want to see a range of new measures including extending prosecution to private property, judging a dog on its behaviour rather than just the breed and also compulsory micro-chipping. He feels this could change the behaviour of owners and act as a deterrent., In addition, changes have been made to the Criminal Injuries Compensation Scheme which will no longer include dog bites. CWU say that 5,000 postal workers are attacked by dogs each year. In particular, the report singled out Lloyds and will be investigating their methods more fully. However 22 banks and insurers were found to be incentivising staff to mis-sell. 40% of Lloyds staff get extra payments if they can sell financial products. Some staff members were even selling products to their family members and friends to get the bonuses and others were overcharging customers to get to sales targets. In other cases staff do not receive a basic salary and must rely on the bonuses for their take-home pay. The FSA have insisted that this behaviour must stop within 18 months. They would like to see commission payments benefiting the customer rather than staff. The FSA Chief Executive Martin Wheatley says that banks should serve people not sell to them.
