Fell into a vat of Curry? Fired for having a stroke? Far-fetched concepts now an almost common reality [11th Jul 2011]
It has emerged this week that council bosses in Brighton and Hove have paid £7,000 to a boy in compensation after he fell into a disused air raid shelter. The boy had climbed over the school fence to retrieve his ball and had been standing on the roof of the shelter when it collapsed. A similar incident occurred after a child fell down a manhole in a playing field. This resulted in a payment of more than £3,000. In fact more than 347 playground incidents were compensated across the UK last year. One was even paid out after a boy scratched himself on a rose bush. It has been pointed out by the Taxpayers Alliance that schools and councils need to be more willing to fight these cases to save taxpayers money. Oil company BP is seeking to stop payments based on future losses for those still recovering from the oil spill in the Gulf of Mexico. The $20 billion compensation fund which was formed following the spill was designed to help those who had ongoing problems with their livelihoods due to the spill. However BP have claimed in a document released this week that there was evidence that economic recovery was well under way and that compensation claims should be adjusted to take account of this. They claim that evidence of recovery include the fact that hotels are back to pre-spill occupancy levels, fishing grounds have reopened and seafood from the area has been deemed safe to eat. So far there have been around 857,000 claims from more than 500,000 businesses and individuals. The fund has paid out $4.5 billion so far. A woman who fell into a huge cooking pot while working for Shobha UK Ltd is seeking compensation for her burns. The compensation was being sought from the firms insurance company Aegas, however liability was being denied. Sudesh Bala was working alone in the kitchen when she slipped into the pot which contained 50kg of curry. She was unable to get out of the pot for ten minutes. She had been working on the order which was for 500 people and was to be served at the NEC. The company have since gone into liquidation. Aegas say they cannot comment on the case as it was going through the courts however the ambulance crew which attended could confirm they had helped a woman who had burns to her legs and buttocks. A pensioner from South Sheilds has been denied compensation after she was diagnosed with mesothelioma due to asbestos exposure. Liliian Rose Asmussen had launched a claim for compensation against Filtrona UK, the company which bought her former workplace. However it was found that the exposure to asbestos took place before its dangers were fully known. The judge found that employers were entitled to rely on the established practices of the time and that even if advice had been sought by the employer at the time, it is unlikely they would have been told to take any particular precautions. A Welsh builder has been awarded the largest payment for discrimination in Welsh history. Jonathan Jones received more than £390,000 at an employment tribunal in Cardiff this week. It was accepted that Mr Jones' employer Jewson Ltd had discriminated against him when he was sacked just five months after he suffered from a stroke. Mr Jones had worked as a branch manager and had often worked for 60 hours a week without taking his holidays. Originally, Jewson had offered Mr Jones just £57,000. A Scottish man who is seeking compensation from the government for his exposure to radiation as a result of nuclear testing in the Pacific during the 1950's has gone to Alex Salmond for help. There are currently 1,000 litigants across the UK who are fighting for compensation. Ken McGinley has taken his fight to the Scottish government in the hope that they will be able to force the UK government to allow compensation to be paid. |
