Compensation for Accidents in the Workplace
If you have ever worked in a place that does not have the basic safety measures in place, then you would immediately understand the significance of the workplace accident compensation law. When you are working at a hazardous place and you are not given the proper safety equipment, then you would be in danger of getting injured. If you do get injured, then you would have to spend a lot of money in terms of the medical and hospital bills. But since it is the responsibility of the employer to ensure the safety of the workplace, he would be liable for the damages. If you are working at a height that is more than the prescribed norm, then you would have to be given the proper safety harnesses and protection so that you do not injure yourself while you are working. Any equipment that is required, like a ladder, should be provided so that the job can be done properly. If none of this is provided, then you would be in danger of getting injured while you are on the job. Therefore, your employer should make sure that all the necessary equipment is provided for the use of the employees. For example, if you are working with any equipment and it turns out to be faulty and injures you, then you can claim compensation for that. Equipment like chainsaws or machines like elevators should be in perfect condition. If they are in faulty condition, then they would definitely injure the person using them. In fact, using such faulty equipment could be very dangerous to the life of the person as well. The employer should ensure that any equipment that is provided works properly. All the employee has to do is show that the injury was caused because of the use of the faulty equipment. Another place that accidents can happen is at building sites. If you are working at a building site, then you should always have protective head gear on you. The reason is that there is always the possibility that any object might fall from above. In such cases, it would be very dangerous if it hits your head. Head injuries have a high rate of fatality and so your employer should ensure that you are provided with all the proper equipment. Otherwise, he would be liable for any accidents that may occur at the construction site. In construction sites, there would be a lot of equipment used for different activities. The employer should ensure that all of them are in perfect working condition before the employees are allowed to work on them. If it is found that faulty equipment was used and that an employee got injured because of that, then it would be the employer that would be liable. He would have to compensate the employee for all the costs that would have been incurred because of the injury sustained at the workplace. He would also be censured for not providing the proper tools. On the whole, you as an employee, have the right to expect equipments that are functioning properly so that you can do your job effectively. Your employer should also ensure that the place where you work is a safe environment. If you are asked to work in a hazardous environment, you can refuse to do so if you are not given the proper protection. Any injuries that are sustained while you are working for your company can be claimed from your employers. They would be legally bound to pay the medical and hospital bills that you have incurred because of the accident. |
