Bus Driver Awarded Compensation after Being Sacked over Consumer Website Comment [21st Nov 2011]
A bus driver who was sacked after one of his trips received a negative review on Trip Advisor has been awarded £2,600 in compensation. David Marshall worked for Rabbie's Trail Burners in Edinburgh and the trip in question was three days to Skye. It was discovered that the passengers were due to visit a castle, which was closed. The driver then consulted with the passengers and it was decided to go to Inverness instead. However a review on Trip Advisor claimed that the passenger was not happy about this change. In addition Mr Marshall was accused by his employers of meeting a friend when he was supposed to be working, but after dropping off his passengers. Mr Marshall was clear that all passengers had agreed to the change and that his stop in the layby was for a rest. An employment tribunal found in his favour. He was described as a credible witness. The employer are appealing. A boy from Oxford has been awarded £1 million in compensation after he was left brain damaged due to complications surrounding his birth. Dontay crooks was born at The John Radcliffe Hospital and now has severe cerebral palsy and needs round the clock care. He can only see light and dark and has severe learning difficulties. The settlement is £50,000 per year until he is 11 and then £80,000 per year until the age of 18 when he will get £140,000 each year to pay for his care. A spokesperson for the hospital trust has commented that the settlement was reached last month and that they wish the boy and his family the best for the future. A family is asking for compensation from supermarket giant Tesco after they discovered a dead bird in their pre-packaged salad bowl. Paul Streeter and his sons had sat down to watch the football with pizza and salad which was cooked by his partner Julia Flynn. Ms Flynn says she had eaten most of the salad when she discovered the dead bird at the bottom. Other members of the family had already eaten most of their salad as well. Ms Flynn, who is a vegetarian was sick three times after the discovery. The bird was taken back to the store in Burnham, where customer services took the decomposed and skeletal bird away. Mr Streeter has said that his family want compensation, not because they have a vendetta against Tesco, but because they don't feel Tesco have taken the issue seriously enough. Tesco have commented that they are very disappointed to learn of the incident and a thorough investigation will be carried out. A European Law change has meant that UK travellers who are injured while abroad could receive less compensation than they currently do. The law now states that those hurt overseas will be treated according to the law in the country where their accident happened. In most cases this means lower payments. Clive Gardiner from First Travel has said that the company is very worried about these new rules and that they feel it is unfair. He points out that the costs of rehabilitation in the UK are more than would be required in most other EU countries and that the cost of living is higher in the UK. It was also suggested that other countries offer more in terms of social security provision and so the compensation awarded is lower. The warning which has come from the company has resulted for a recent case where a man who was injured in France and left brain damaged and has only just been judged. The insurers were unsure whether French or UK compensation rules would apply. The case has mean that a date of January 11 2009 has been placed on all future cases and that injuries which occurred after this time will be subject to the new rules. |
