Compensation Likely to be Refused again for Airline Volcanic Ash Delays and the UK is the Whiplash Claim Capital [23rd May 2011]
With a new volcanic eruption in Iceland, those who are booked to go on holiday in the next few days and weeks are questioning their right to compensation should their flights be cancelled or delayed. It is thought that the plume of ash from the Grimsvotn volcano will reach Scotland by Tuesday or Wednesday of this week and will reach England by the end of the week. The Civil Aviation Authority has said that airlines are required to offer meals, refreshments and hotel accommodation if a flight has been rearranged. Those who have to arrange their own accommodation or food should keep their receipts and claim reimbursement. EU rules also state that passengers can receive up to 600 Euros for cancelled or heavily delayed flights. However it could be argued that an eruption may be considered an extraordinary even and may not be covered. Three women who were illegally trafficked into the UK and forced to work for no pay in Enfield are to receive compensation for the Met Police. The women were taken from Nigeria as children and worked long hours for families in the area. A judge found that the Met had failed to investigate complaints and awarded the women £5,000 each. The Met have said that the way they investigate cases like this has significantly improved due to the introduction of a dedicated unit for immigration and human trafficking cases. Mobile provider O2 has apologised for an outage which left thousands of users across London, East Sussex and Kent without service for much of the day on Sunday 22nd May. The problem was caused by thefts of equipment and hardware damage at an East London facility. Despite the length of the service outage, the provider has said they will not be offering compensation. They point out that events like what happened are very rare and out of their control. The Association of British Insurers has described the UK as the "whiplash capital of the world" with 1200 claims of this nature being made every day. This is 12 times as many claims as were made for workplace accidents. Whiplash can be very difficult to diagnose and easy to exaggerate or fake. Around £2 billion a year is paid out by insurance companies as compensation for this type of injury. James Walton from the ABI has commented that he doubts that the UK has weaker necks than the rest of Europe and that it has to be down to fraud. The ABI is also asking that the government goes ahead with its reform of the civil justice system to allow fair compensation and fewer fraudulent claims. It is also pointed out that these claims can push up insurance costs for all motorists by as much as £40 a year. Samantha Gooding from the Bury area is to receive a compensation payment of seven figures after she was born with no heartbeat. Samantha is now 23 and has developed epilepsy and has cerebral palsy. A damages claim was launched against the East of England NHS Trust by Samantha's father. He says that he wanted to secure her future. This week a High Court judge approved the claim after it was found that inadequate monitoring as to blame for the damage to Samantha's brain. In addition it took doctors 25 minutes to revive her when she was born prematurely. Her mother had been admitted with high blood pressure. Her parents say she will now be able to live independently with a carer. "Celebrity" Katie Price is to sue a Los Angeles hair salon for compensation after her hair extensions caused damage to her hair and cost £45,000 to correct. The model had travelled to the US to see one of the most renowned hairdressers in the area - Lea Journo. After the treatment which took 48 hours to complete, Price complained that the extensions had started to tug at her hair and were breaking off and pulling her hair from the roots. Hairdressers in the UK confirmed the extensions had been applied unevenly and that her hair was weak from over-colouring.
